حكم أخذ الغرامة ( العوض )

نرجو إفادتنا حيال غرامة حوادث السيارات ، فهناك من يحرم وهناك من يجيز ، مع العلم بأن هناك من وجد الأمر برمته جيدا حيث لا يخسر إلا قيمة إصلاح سيارته

بسم الله الرحمن الرحيم الحمد لله والصلاة والسلام على رسول الله . من أحدث لغيره ضررا في سيارته أو غيرها فيجب عليه أن يدفع ما يرفع الضرر الذي سببه، لأن العمد و الخطأ في أموال الناس سواء، ولا حرج في أخد العوض وإن سماه الناس غرامة، فهي جائزة، لأن من سبب الضرر متعد، والخطأ يرفع عنه الإثم ولا يرفع عنه الضمان . الصادق بن عبد الرحمن الغرياني
